Terms of use
Version of November 6, 2026
This English translation is provided for convenience only. The French version (conditions générales d’utilisation) is the authoritative one and prevails in case of any discrepancy.
1. Purpose and acceptance
These terms of use (the “Terms”) govern access to and use of the Saymock service, an online collaborative design tool available from saymock.com, app.saymock.com and its MCP server (the “Service”), published by Tristan Laroubine, sole proprietor (entrepreneur individuel, EI) (the “Publisher”; contact details in the legal notice).
Any use of the Service, including without signing up (guest account), constitutes full and unreserved acceptance of the Terms. Creating an account requires their express acceptance. If you do not accept the Terms, you must not use the Service.
Paid plans are also governed by the terms of sale (the “Terms of Sale”), which prevail over the Terms in case of conflict. The processing of personal data is described in the privacy policy.
2. Definitions
- User: any person who accesses the Service, with or without an account.
- Consumer: a User who is a natural person acting for purposes outside their trade, business, craft, profession or farming activity.
- Business User: any User who is not a Consumer, in particular one who uses the Service for the needs of their business or on behalf of an organization.
- Workspace: a working space grouping projects, files and members, administered by one or more Users.
- Content: all data that the User, their members or their Agents place in the Service: mockups, HTML code, text, images, fonts, comments, files and metadata.
- Agent: any third-party software, in particular an artificial intelligence assistant (Claude Code, Cursor or another MCP client), that the User connects to the Service to act on their behalf.
- Token: any personal access credential (API token, OAuth token, sign-in link) used to act in the Service on behalf of a User.
3. Access to the Service
The Service is available to people aged 15 or over. A User who uses it on behalf of an organization represents that they have the authority to bind it; the Terms then apply to that organization.
Accessing the Service requires equipment, an up-to-date browser and an internet connection, all at the User’s sole expense. Telecommunication costs and subscriptions to third-party services (internet access provider, Agent provider) remain the User’s responsibility.
4. Account, Tokens and guest account
Users sign up with a valid email address or through a third-party identity provider (Google, GitHub). They undertake to provide accurate information and to keep it up to date.
The User is solely responsible for keeping their means of access (mailbox, third-party account, Tokens) confidential and for any action carried out with their account or Tokens, including by an Agent or by a third party to whom they disclosed them. They inform the Publisher without delay of any unauthorized use and revoke the Tokens concerned.
The guest account, created without signing up to try the Service, is temporary. It is deleted, together with its Content, after 30 days of inactivity, unless the User links it to an account. No retention is guaranteed for a guest account.
The administrators of a Workspace decide on its members, access rights and share links. They are responsible for the access they grant, including through a public link, and for the Content thereby made available to third parties.
5. Description and evolution of the Service
The Service lets Users design screens as HTML and Tailwind classes, together and with Agents, comment on them, share them and capture screenshots of them. Its features are described on the website for information purposes only.
The Service is under active development. The Publisher may at any time change it, add, modify or remove features, usage limits or integrations, in particular for technical, security or legal reasons. Features presented as “beta”, “experimental” or “preview” are provided on a trial basis and may be changed or removed without notice.
The free Service and the guest account are provided as is and as available, without any warranty of results, performance, compatibility or fitness for a particular purpose, in particular as to the fidelity of renderings, screenshots or generated code.
6. Availability
The Publisher makes reasonable efforts to keep the Service available 24/7, under a best-efforts obligation (obligation de moyens). No availability, continuity, recovery time or performance is guaranteed, unless the Publisher makes a specific written commitment.
Access may be interrupted, slowed down or suspended, with or without notice, in particular for maintenance, updates or security operations, because of a failure of the host, of a supplier or of telecommunication networks, a cyberattack, an overload or a force majeure event. Such interruptions do not give rise to any compensation, subject to the mandatory provisions applicable to Consumers.
7. Artificial intelligence Agents and third-party services
The Publisher does not provide or call any artificial intelligence model. Agents are chosen, configured and used by the User, under their sole responsibility and under the terms of their providers, to which the Publisher is not a party.
An Agent connected to the Service acts on behalf of the User, with the User’s rights. Any action by an Agent (creation, modification, deletion, sharing, comment) is deemed to be carried out by the User who connected it. The User is solely responsible for checking Content produced by an Agent, which may be inaccurate, incomplete, unsuitable or infringe the rights of third parties.
Content that an Agent reads in the Service is transmitted by the User to that Agent and, where applicable, to the provider of the model it uses. The Publisher is not responsible for these transmissions or for how these third parties use them.
The Service relies on third-party services (identity providers, Google Fonts, images hosted at external addresses, icon libraries). The Publisher is not responsible for their availability, their content or their terms.
8. User Content
The User retains all rights to their Content. They grant the Publisher, worldwide and for as long as the Content is hosted (backups included), a non-exclusive, royalty-free license to host, reproduce, technically adapt, display and transmit it, solely to the extent necessary for the operation of the Service (rendering, screenshots, thumbnails, synchronization, sharing as intended by the User).
The User warrants that they hold all necessary rights to their Content and that the Content, and its use in the Service, complies with the law and the rights of third parties (intellectual property, trademarks, image rights, privacy, personal data).
With respect to Content, the Publisher acts as a host. It does not monitor Content in general and is liable for it only under the conditions provided by law, in particular if it fails to act promptly to remove manifestly unlawful Content that has been duly reported to it (reporting procedure in the legal notice). It may remove or disable access to any Content that is unlawful or contrary to the Terms.
9. Retention and backup of Content
The Service is not an archiving service. The User is solely responsible for keeping a copy, outside the Service, of any Content they value, in particular by using the export and HTML copy features.
The Publisher makes regular backups solely to restore the Service in the event of an incident; they are not a service provided to the User and no individual restoration is owed. Files moved to the trash are permanently deleted after 30 days.
10. Prohibited uses
The User shall not, directly or through an Agent:
- use the Service for unlawful purposes, or to publish or share content that is unlawful, hateful, violent, pornographic, defamatory, misleading or infringing;
- create pages impersonating a third party (phishing, fraudulent collection of credentials or payment details);
- undermine the security or integrity of the Service: introducing malicious code, circumventing access controls or limits, penetration testing or vulnerability scanning without the Publisher’s prior written consent;
- overload it, in particular through excessive automated requests, or extract data from it on a massive scale;
- decompile it or reproduce how it works, except as permitted by Article L. 122-6-1 of the French Intellectual Property Code;
- resell, rent or make it available to third parties as a service, without the Publisher’s written consent.
11. The Publisher’s intellectual property
The Service, its software, interfaces and documentation, and the Saymock brand and logo belong to the Publisher or its licensors. The Publisher grants the User a personal, non-exclusive, non-transferable and revocable right to use the Service, for the duration of their access and in accordance with the Terms. No other right is granted.
Suggestions and feedback that the User sends to the Publisher may be freely used by the Publisher to improve the Service, without compensation.
12. Liability
The Publisher is bound by a best-efforts obligation. It shall not be liable for:
- indirect damages, such as loss of revenue, profits, customers, opportunity, reputation or data, or the cost of procuring a substitute service;
- damages resulting from an interruption, unavailability, slowness or malfunction of the Service in the cases provided for in Article 6;
- the loss, alteration or disclosure of Content attributable to the User, their members, their Agents, the people they gave access to, or a third party who obtained their means of access;
- Content, its accuracy and its lawfulness, or decisions made or code developed on the basis of the Service;
- the acts of Agents, of artificial intelligence model providers and of the third-party services mentioned in Article 7;
- an intrusion or cyberattack that occurs despite security measures in line with the state of the art;
- any use of the Service that does not comply with the Terms or its documentation.
Business Users. For free use of the Service, the Publisher’s total liability to a Business User, for all causes combined, is limited to one hundred (100) euros. For paid plans, the cap set out in the Terms of Sale applies. Any claim by a Business User against the Publisher is time-barred one year after the event giving rise to it. These limitations are a decisive element of the Service’s economic balance, in particular of it being free of charge.
Consumers. The provisions of this article apply to Consumers only to the extent permitted by law. They do not deprive Consumers of their right to compensation for harm resulting from a breach by the Publisher of its obligations, nor of the statutory warranties they benefit from.
No limitation applies in the event of gross negligence or willful misconduct by the Publisher, or of personal injury.
13. Indemnity owed by Business Users
The Business User shall indemnify and hold the Publisher harmless against any claim, action or judgment by a third party or an authority based on their Content, on the actions of their members or their Agents, or on use of the Service contrary to the Terms, and shall bear the resulting costs, including reasonable attorneys’ fees.
14. Suspension, termination and deletion
The User may stop using the Service at any time and request the deletion of their account at contact@saymock.com.
In the event of a breach of the Terms, the Publisher may suspend or terminate the User’s access after a formal notice that has remained without effect for 8 days. It may do so immediately and without notice in the event of a serious breach, of a risk to the security of the Service or of other Users, or at the request of an authority.
The Publisher may discontinue the free Service, in whole or in part, by informing the Users concerned at least 30 days in advance, so that they can retrieve their Content.
After an account is closed, its Content is deleted within 30 days, then disappears from backups within the following 14 days, except for data the Publisher must keep under a legal obligation. The Content of a shared Workspace remains available to its other administrators.
15. Personal data
The processing of personal data carried out by the Publisher is described in the privacy policy. A User who places personal data of third parties in the Service (invited members, mockup content) is responsible for the lawfulness of that processing.
16. Force majeure
Neither party is liable for a failure caused by a force majeure event within the meaning of Article 1218 of the French Civil Code. In addition to the cases recognized by case law, the following are in particular considered as such: failures of the host or of telecommunication networks, large-scale cyberattacks, power outages, decisions of an authority and natural disasters.
17. Changes to the Terms
The Publisher may change the Terms to reflect changes in the Service, the law or case law. Users with an account are informed by email or in the Service at least 30 days before a substantial change takes effect; if they refuse it, they may close their account before that date. Continuing to use the Service after that date constitutes acceptance.
18. Miscellaneous
The Terms, and where applicable the Terms of Sale, constitute the entire agreement between the parties on their subject matter. If a provision is held void or unenforceable, it is deemed unwritten without affecting the others. The Publisher’s failure to enforce a breach does not constitute a waiver of its right to do so later.
The Publisher may assign or transfer the agreement to any person who takes over the operation of the Service, in particular a company it would form, provided that the assignment does not reduce the User’s rights; the User is informed of it.
The logs and records of the Publisher’s systems are evidence of the actions carried out in the Service, unless proven otherwise.
19. Governing law and disputes
The Terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution; the User sends a written complaint to contact@saymock.com.
If this fails, a Consumer may bring the matter before the competent court under the ordinary rules of law; they retain the benefit of the mandatory provisions of the law of their country of residence.
Between Business Users and the Publisher, and to the extent permitted by Article 48 of the French Code of Civil Procedure, any dispute relating to the Terms falls under the exclusive jurisdiction of the courts within the territorial jurisdiction of the Aix-en-Provence Court of Appeal, including for summary proceedings, third-party claims or multiple defendants.
